Withholding of Removal

Withholding of Removal

There is another type of benefit that is similar to Asylum called “Withholding of Removal”, but is only available in limited circumstances, and it is much harder to win approval.  For example, it is only possible to apply “defensively” for this benefit.  One can only apply for it in Immigration Court Removal Proceedings, after the process of deportation has begun.  However, there is no one-year limit for applying for withholding of removal.  Sometimes a person who qualifies for withholding of removal can also qualify for a work permit while their case is going on in Immigration Court, while that person waits for a final decision.

Lessons from the Past

The ultimate relationship between justice and law will be an eternal subject for speculation and analysis. But it may be said that in a democratic society law is the form which free men give to justice. The glory of justice and the majesty of the law are created not just by the Constitution–nor by the courts–nor by the officers of the law–nor by the lawyers–but by the men and women who constitute our society-who are protectors of the law as they are themselves protected by the law.
